Terms of Service

THE AGREEMENT

These terms are between you and FITTSO Operations, Inc., an Alaska corporation ("FITTSO", "we"). The consumer app is provided to you free of charge by our affiliate FITTSO Foundation, Inc. under these same terms. By creating an account you accept them, together with the Privacy Policy and the Consumer Health Data Privacy Policy.

ELIGIBILITY

You must be 18 or older. Age is checked when your account is created. Accounts created by anyone under 18 will be closed.

BETA

FITTSO is in closed beta. Features change, break, and disappear. Data may be reset. The service is provided as-is during beta and we make no availability commitment. Public launch is planned for January 1, 2027.

NOT A MEDICAL DEVICE

FITTSO is a wellness and fitness product. It is not a medical device. Nothing in the app — including FITTSCORE, THEIA, MacroSnap, or any figure, trend, citation, or suggestion — is a diagnosis, a treatment, or medical advice. Values from consumer devices are presented as what they are. Do not use FITTSO to make medical decisions. Talk to a licensed clinician. If you think you are having a medical emergency, call emergency services.

YOUR ACCOUNT

You are responsible for your credentials and for what happens on your account. One person, one account. Tell us immediately at zac.s@fittso.app if you believe your account has been accessed by someone else.

YOUR CONTENT

What you post stays yours. You grant us the license we need to store it, process it, and show it to the people you have chosen to share it with — nothing more. You are responsible for having the right to post what you post. Content on FITTSO is held to a PG-13 standard; sexually explicit content is not permitted.

WHAT YOU MAY NOT DO

  • Scrape, bulk-export, or resell other users' data
  • Reverse-engineer the service or any device partner's methodology through it
  • Impersonate anyone, or harass, threaten, or abuse other users
  • Post content that is unlawful, sexually explicit, or that you do not have the right to post
  • Use the service to provide clinical care without the qualifications and authority to do so
  • Interfere with the service, its security, or other users' access to it

CONNECTED SERVICES

When you connect a device partner, that partner's own terms and privacy policy continue to apply to your relationship with them. We are not responsible for their services, their accuracy, or their availability. Additional terms some partners require of us are published at fittso.app/legal/partner-data. Partner names appear in FITTSO for compatibility and provenance only and do not imply endorsement.

THEIA

THEIA is artificial intelligence, not a person and not a clinician. It can be wrong. It answers health questions by citing published sources and will not give you a personal dose or diagnosis. Anything THEIA remembers about you is governed by the consent you give in the app and by the Privacy Policy.

FEES

The consumer app is free and contains no in-app purchases. If we introduce paid features, they will be offered separately and we will say so clearly and in advance.

DEACTIVATION AND TERMINATION

You can deactivate your account (reversible) or delete it (permanent, after a 30-day grace period) at any time in the app. We can suspend or close an account that violates these terms. Sections that by their nature survive termination, do.

DISCLAIMERS AND LIMITS

To the fullest extent the law allows, the service is provided without warranties of any kind, and our total liability to you for any claim arising from the service is limited to one hundred US dollars. Some jurisdictions do not allow these limits, in which case they apply to the extent permitted.

GOVERNING LAW AND DISPUTES

These terms are governed by the laws of the State of Alaska, without regard to its conflict-of-laws rules. Any dispute that cannot be resolved informally — write to us first at zac.s@fittso.app and give us 30 days — will be brought in the state or federal courts located in Alaska, and you consent to their jurisdiction. If we adopt a binding-arbitration procedure in a future version of these terms, you will be asked to accept that version before it applies to you, and it will include an opt-out window and a small-claims carve-out.

CHANGES

If we change these terms materially we will tell you in the app and ask you to accept the new version before you continue. This is version 2026-09-12.1, effective September 12, 2026.
